The EB5 Programme at a glance


Established by the US Congress in 1990, the EB5 visa stands for Employment Based Visa, Preference 5, and is found in Section 203 (b) (5) of the Immigration & Nationality Act (INA). The program seeks to attract foreign direct investments into the US, with a strong emphasis on for-profit enterprises that create permanent jobs for US workers.. 

Who is the EB5 for?

EB5 allows immigrants seeking to enter the US to engage in a commercial enterprise, or invest in an existing eligible project, that will benefit the US economy by substantial creation of jobs for American workers.

How does it work?

Applicants make an EB5 visa investment via a pre-approved Regional Centre, and are then issued with a Green Card. This provides Permanent Residency rights for the applicant, their spouse, and any dependent children under the age of 21.

Eligibility and investment options

Eligibility requirements

An eligible applicant must meet each of the following requirements:

  • Be at least 21 years of age

  • Demonstrate legal source of assets and funds

  • Choose from one of the available investment options.

Investment options

There are 2 investment options within the EB5 visa program:

  1. Create of a new US enterprise employing at least 10 US citizens, or

  2. Invest in a Regional Centre (Applicable to our EB5program approach). Regional centres are investment opportunities that have been pre-approved by the USCIS.

Eligibility criteria

To be eligible, an applicant must meet the following criteria:

  • Make a qualifying investment of US $500,000 or more, and complete payment of a further US $46,000 in management and application fees.

  • The enterprise needs to create full time employment for at least 10 qualified US workers as per the program’s requirements.

  • Active management of the enterprise is not required.

  • The investment matures after a period of 5 years at market interest value.

  • Citizenship application requirements

    If you are a non-conditional Green Card holder for no less than 5 years, you must meet the following requirements to become eligible to apply for naturalisation:

    • You need to be 18 years of age or older.

    • You need to have continuous residence in the US, as a Green Card holder, for at least 5 years immediately prior to your application.

    • You need to have lived within the USCIS district with jurisdiction over the applicant’s place of residence or state for a minimum of 3 months prior to your citizenship application.

    • You need to have Resided continuously within the US from the date of application for naturalisation up to the time of naturalisation.

    • You need to have been physically present in the US for no less than 30 months out of the 5 years (60 months) immediately preceding your application.

    • You must be able to read, write and speak English, and have knowledge and an understanding of US government and history.

    • You must be a person of good moral character, aligned with the principles of the US Constitution, and well disposed to the good order and happiness of the country during all relevant periods under the law.
